1. Scope of Terms and Conditions

These terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

 

 2. Formation of Contract

The provision of the (custom-made) products offered in the Farocchi online shop is non-binding. By submitting your order in the final step of the shopping cart checkout, you, as the customer, are making a binding purchase offer. Following your order, you will receive an email confirming receipt of your order and outlining its details. It is important to emphasize that this email does not constitute acceptance of the contract, but merely reiterates your offer. The contract is concluded only when we send you a separate order confirmation or the goods are actually delivered. In the case of selecting prepayment via bank transfer, you will be asked in the order confirmation to make the payment within 7 working days.

The processing of your order will only commence once the total amount of your order has been received in full in our account. For payments made via credit card or PayPal, the order amount (including any shipping costs) will be debited upon acceptance of your order.

If the total amount of your order is not received in our account within 7 days of sending the order confirmation, we reserve the right to withdraw from the contract. In this case, your order will be considered void, and we have no obligation to deliver the goods. The order will then be deemed completed by both parties, without further consequences.

 

3. Right of Withdrawal

Exclusion of the Right of Withdrawal for Custom-Made Products

For contracts for the delivery of goods that are custom-made according to customer specifications, there is no right of withdrawal according to § 312g Abs. 2 Nr. 1 BGB. By ordering custom-made products from the Farocchi online sales platform, the customer agrees that the right of withdrawal is excluded.

 

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Dapper & Rama GbR, Pöckinger Straße 13B, 82319 Starnberg, Germany, info@farocchi.com, Phone: +49 152 23278092 / +49 152 23247800) of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post or an email). You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification regarding the exercise of the right of withdrawal before the withdrawal period has expired.

 

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received your notification of withdrawal from this contract. For this refund, we will use the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in no case will you incur any fees due to this refund. We may withhold the refund until we have received the goods back or you have provided evidence that you have returned the goods, whichever is the earlier.

You must return the goods to us without delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this loss in value is due to handling them in a way that is not necessary to ascertain their nature, characteristics, and functioning.

 

4. Product Offer

The Farocchi online shop offers clothing that can be customized in design and size by the customer. Photos represent processed materials and design options as accurately as possible. However, individual perception may vary due to technical settings of output devices and is consequently subjective.

 

5. Subsequent Adjustments, New Production, and Refund of Customized Products

 

Subsequent Adjustment of Goods

To ensure customer satisfaction, Farocchi covers adjustment costs for custom-made products in case of measurement inaccuracies by the tailor. The customer can raise objections regarding the measurement inaccuracies within 21 days and submit the invoice for an adjustment to Farocchi via email (info@farocchi.com). Farocchi will cover the invoice amount up to a maximum of 15% of the purchase price.

 

New Production/Refund

The customer can reject subsequent adjustments and request new production or a refund. This is possible if a subsequent adjustment is impossible or entails excessive effort. When requesting new production or a refund, the disputed product will be evaluated by Farocchi to determine whether an adjustment would be more suitable for customer satisfaction. Farocchi reserves the right to prefer a refund in the case of a request for new production. The customer is responsible for returning the disputed product in an intact condition and must bear the shipping costs. The new production must not deviate from the original product characteristics.

 

6. Prices

All prices in our online shop are stated in Euros and are payable in Euros. For orders within the European Union, where the delivery location is also within the European Union, all taxes are included in the stated price. Shipping costs are product-dependent but will always be indicated at the time of order placement.

8. Shipping Costs

For orders with custom-made products, the delivery time is generally 4 weeks. Variations may occur due to shipping circumstances and manufacturing delays, and thus a delivery time cannot be guaranteed. Shipping costs are product-dependent and will always be indicated at the time of order placement. Due to unavoidable extreme events such as wars, states of emergency, and trade blockades in Germany and the respective production countries, Farocchi reserves the right to extend delivery times or declare purchase contracts void.

10. Governing Law and Jurisdiction

German law applies. The provisions of the UN Sales Law expressly do not apply. The jurisdiction is our registered office, provided this is legally permissible.
